Pride flags beyond the rainbow: What pansexual, bi and others mean

Imagine you are just chilling, enjoying your day, having your favorite cup of Araku Signature or some other niche artisan coffee you like. You might want to read a book or watch a movie, or look! your favorite youtuber uploaded a new video you can go watch that. Whilst you were busy doing that a person just bursts into your house, they do not belong there. They tell you to ditch your coffee and drink some random sachet coffee, they do not let you read your book or even watch the movie, worst of all they will unsubscribe to your favorite youtuber (or substack writer, me :P). You can do nothing, but obey to them, they are not you, they should not have authority over you but they bar you of your choices, they bar you of your free will.

On the 25th of March, the Government of “Free” India passed a bill which was opposed by most of the opposition and all of the “Free” citizens of India who consider themselves a part of LGBTQIA++ communities. It was passed alongside the commotion of people walking out, funnily enough on a vocal vote basis, suppressing millions of voices who have been misheard for generations. There are a lot of problems plaguing the world right as of now, but our extremely experienced parliamentarians decide to regress on a law which had already been passed once already by the supreme court.

For a little bit of context, the Trans Bill or the Transgender Persons (Protection of Rights) Amendment Bill 2026 is a complete lie when it comes to the “Protection” part of the rights of Trans People. What I cannot fathom to believe is the fact that this bill regresses whatever NALSA Vs. Union Of India upheld, which was the fact that self perceived gender identities were a real thing. Moreover, this bill proposes to remove that altogether taking away the autonomy of a person to not be able to choose what they perceive themselves as altogether. It is pure unhinged behavior that they wish to box gender identities into specified boxes where only people with those certain characteristics can be considered to be part of the officially recognized. Heck, I would argue for the fact that this vague definition of what they would or would not consider to be transgender or not is inherently transphobic and homophobic.

Where they talk of “Medical Persons” or “Persons with Medical Expertise” they fail to explain what exactly either of the terms will mean, leading to more unnecessary ambiguity to whatever bullshit they have got cooking in their heads. Moreover they did not find in themselves enough happiness invading the right to self-determination of people, rather they also invade the right to privacy of a person as the extent of “Medical Board” and examinations remain suspicious.

The National Council for Transgender Persons were even invited to meet with the Minister for Social Justice who proposed the bill in the first place, but when they arrived they were met with disappointment as they were denied the meeting by the minister himself who cited “Family Emergency” concerns. It is all fair and fine, but even though after that incident, the government was aware that this meeting could have been arranged but they chose not to arrange it and went with passing the bill anyways, disregarding any chance of a review by the NCTP which is supposed to be working with the government in the first place.

There have been cited many a reason for the “rush” to pass this bill and make the law. I am not here to dabble in conspiracies, but I would like to propose questions for the administration.

Why are we still hung up on proper representation of people in a democracy that is almost on it’s 80th year? Why have we not figured it out yet?

Why must there be laws made for an extremely discriminated community from people who are unaware of what values this community has stood for? Without even some basic research how do we let them decide the fate of an entire population?

The sufferer can only describe suffering, but an ally can help by just being aware of how bad is the oppression when it comes to the LGBTQIA++ community as a whole. I am a cis-male het individual, I do not write much about the LGBTQIA++ community because I am afraid of misrepresenting them yet here I am talking about how badly made this law is because this is important, as important as it ever has been. This bill has been outraging lakhs upon lakhs of people in India who call this bill an absolute mockery of the fundamental rights and the freedom of the people.

The government and the social justice ministry say that this is for the “upliftment” of people who have faced social exclusion, but rather I’d argue on the contrary. When you try to box something which is meant to be as fluid as gender, it genuinely does not work at all. It gives more leeway to the people who see this as unimportant to start harassing the people who belong to LGBTQIA++ community and lead to even more discrimination than how it was before. It also gives way for the few recognized communities on the board to go through even more discrimination on the basis of how they live, and the government will brazenly go and classify them as “Men in Sarees”, “Dancers”, “Sex Workers” and much more of those horrible homophobic terms, because honestly, what can stop them from doing so? they have not specified any checks and measures for the medical record review process, so these are all the things that can be manipulated.

The establishment thinks of it’s own people as dumb nincompoops who have no right to think, or even self-governance or self determination of who you really are. Moreover, it’s the fact that the establishment does not wish to even understand or comprehend the sheer gravity of all the things they are talking about.

The fact that social media has to raise concerns about how this is a literal violation of right, free will and pre-established right to self determination of sex by the country’s own supreme court is a testament to how uninformed and useless the administration has made themselves out to be. Renuka Chowdhury, one such MP in the opposition rightfully pointed out the fact that if we take even 5 MPs from the ruling to describe what the bill actually entails and how it affects their stakeholders, they won’t be able to speak anything at all.

The right to life, and the right to preserve their own dignity of the people who are affected by the bill will also come to a great harm. Because it does not matter to the government anymore. They divided on the basis of religion, caste, class and then the final thing they can divide the people on is gender. Which is a goal they have been pursuing plenty well so far, with the amount of transphobia and homophobia, I anticipate must be a part of every transgender or queer person’s life right now.

What I need to put forward for everyone to understand is the fact that gender is a term that cannot be boxed. It is not meant for the governments or any administration to decide who YOU are. They are nobody to tell you what to believe yourself. Gender is a fluid term, it can mean many things and at the same time it can be many things too. If we try too hard to box it up, make it sensible for old fragile minds who have been conservative since the dark ages, I do not think it is plausible to live in a world like that.

And for that above paragraph, I can be jailed if the government deems it to be under “Whoever, compels any person, whether or not such person is a transgender person, to dress, present, or conduct themselves outwardly as a transgender person against the will of such person” which is a whole plethora of new manipulation and violation of rights, where even people, parents, NGOs, teachers who are supportive of the person’s discovery of oneself can inherently be put in jail just for trying to conjure up a plan to uplift the Trans People in the society. This is what you call Systematic Alienation and realizing the fact that it is gives us even more room to understand how stupid this entire fiasco is.

It is a basic human right. It is who you are. It is who you determine yourself to be. Your identity should be yours, and yours to keep, forever.
